Terms and Conditions

  1. General These general terms and conditions (GTC) regulate all business relations between Azerty Neon (supplier) and its customers (buyer) in the respective version valid at the time of purchase, whether in the online store, by e-mail, telephone or WhatsApp. Terms and conditions of the buyer contrary to these terms and conditions are hereby expressly excluded.

  3. Offer and Delivery The offer can be seen on the website www.azertyneon.com and is non-binding. Product information is mainly for illustrative purposes and is not binding. Price and product range changes as well as technical changes remain reserved. The offers are only valid as long as they are visible on the website and while stocks last.Orders and deliveries are possible in Switzerland and Europe.In the online store, the buyer submits a legally binding offer to purchase by sending his order and simultaneous acceptance of these terms and conditions. The purchase is concluded at the time when the buyer receives an order confirmation from the seller by e-mail. In the online store, the delivery method and the delivery costs are shown.Information on availability and delivery times are not binding. If an item is not available in stock, the buyer will be informed as soon as possible when the delivery can be expected. The seller is not liable for delays in delivery caused by manufacturers or third parties. All information on delivery times is therefore without guarantee and may change at any time. Delivery is at the risk and expense of the buyer.
  4. Prices and Payment Prices are quoted in Swiss Francs (CHF) Euro (EUR) Pounds (GBP) and US Dollars (USD), including VAT (currently 7.7%). The published prices and conditions are subject to change. The effective date is the day of the order by the buyer.The buyer has the option of payment in advance, direct debit, PayPal, credit card (Visa, Mastercard, American Express). In the case of online payments, the value of the goods will be debited on the day the order is received. The seller reserves the right to exclude buyers from individual payment options without giving reasons. Invoices are payable within 20 days of receipt. The seller reserves the right to charge reminder fees and further collection fees after the second reminder. The assignment to a collection agency remains reserved.In case of payment by credit card, the contract and data protection provisions of Worldline(https://www.six-payment-services.com/de/services/legal/privacy-statement.html).The delivered goods remain the property of the seller until full payment. The seller is entitled to make a corresponding entry in the retention of title register. If the buyer is in default of payment of the purchase price, the seller is entitled, among other things, to withdraw from the contract and to repossess the goods.
  5. Procedure of the order Ordering is carried out in the following steps:
    1. Selection of the desired goods
    2. Confirmation by clicking the field “Add to shopping cart”
    3. Checking the data in the shopping cart
    4. Confirmation by clicking on the “Checkout” field
    5. Selecting the payment method and entering the buyer’s data
    6. Checking again or correction of the respective entered data
    7. Binding transmission of the order, payment and acceptance of the General Terms and Conditions by clicking on the “Place Order” field.
    Confirmed orders can no longer be cancelled or changed by the buyer.
  6. Warranty and liability Complaints due to defects or due to incomplete or incorrect delivery must be made to the seller immediately in writing, no later than 24 hours from the date of delivery. Hidden defects must be reported to the Seller in writing immediately, but no later than [10] working days after discovery. If the Buyer fails to notify the Seller in due time, his claims shall expire. After return of the rejected goods, the Buyer shall receive a replacement delivery in the event of a defect. If no replacement delivery is possible, the seller will refund the payment made. In addition, any claim for reduction, rescission or compensation for consequential damage caused by a defect shall be excluded to the extent permitted by law.The buyer forfeits any rights for defects in case of improper use of the goods. Defects resulting from normal wear and tear as well as from improper handling or damage by the buyer or third parties as well as defects caused by external circumstances (improper storage, frost, heat, humidity, incorrect storage, etc.) do not entitle the buyer to withdraw from the contract or to replace the goods. The seller assumes no liability for this. Returned goods are at the expense and risk of the buyer. The products must be packed professionally in the original packaging and sent by registered mail. If the Seller cannot determine any defects that are covered by the warranty or are covered by the manufacturer’s warranty, the Seller may charge the Buyer for the costs of inspecting and shipping the goods.Other claims of the Buyer – irrespective of the legal ground – are excluded to the extent permitted by law. The Vendor, its auxiliary persons and any vicarious agents shall not be liable for any damage that has not occurred to the goods themselves, in particular not for consequential damage, loss of profit or other financial losses of the Buyer. Any liability of the Seller in connection with the offer (in particular incorrect illustrations, texts and prices) and the delivery is excluded to the extent permitted by law.Products ordered by the buyer by mistake will not be taken back or refunded.   7. Cancellation, right of return and right of withdrawal of the buyer Orders of the buyer are binding and the customer is obliged to accept the service. Subsequent changes at the request of the customer are possible at the discretion of the seller. Each piece of Azerty Neon is custom made from scratch. Due to the highly customized nature of our products, we do not offer returns or exchanges. We have a strict return policy on all of our products, including but not limited to Customized Neon Signs. We do not accept returns on items that are considered “change of mind”.Our items are quality controlled before they are carefully packed and shipped. If the item arrives damaged, please do not use the product and contact us at [email protected] within 24 hours of receiving the product with pictures.
  8. Copyrights All texts, images, graphics, video and animation files are subject to copyright and other laws protecting intellectual property. They may not be copied, changed or used on other websites without the consent of the seller.
  9. Data protection The current version of the Seller’s data protection statement, which is available at www.azertyneon.com, shall apply.The Vendor may send the Customer information about other products or services of the Vendor (e.g. in the form of a newsletter or by letter). If the Customer no longer wishes to receive such communications from the Seller, the Customer may unsubscribe at any time by sending an e-mail to [email protected], by letter or by telephone using the contact details provided on [www.azertyneon.com].
  10. Applicable law and place of jurisdiction The Seller expressly reserves the right to amend these General Terms and Conditions at any time and to apply them immediately.All contracts concluded with the Seller shall be governed by Swiss law, excluding the substantive rules of conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods (CISG). In the case of orders placed by private individuals for private use, the place of jurisdiction shall be governed by the consumer protection provisions. In all other cases Zurich is the exclusive place of jurisdiction.
